In the following terms and conditions of contract, Emotive Imagery and 'the photographer(s)' shall mean Maxine Huselbee (and, if specified on booking paperwork, Philip Homer) or, in the event of not being able to attend the wedding, any photographer appointed by Emotive Imagery. The 'clients' are those whose names appear on the booking form and in the event the clients arrange for a third party to meet the costs of booking, the contract remains with the clients.
Payment, Prices & Cancellation:
a) A non refundable deposit of one third of the total balance due is payable upon booking. The next third is due one month prior to the date of the wedding, with the final third due upon receipt of the album/disc/USB Key.
b) Any cancellation of booking must be made in writing (e-mail is acceptable) and in the event of cancellation within 14 days, clients are entitled to a full refund of the deposit. If, after 14 days, cancellation is instructed, the deposit will not be refunded. If cancellation falls within one month of the wedding date, the deposit and second installment are non refundable. If Emotive Imagery manages to re-book the date, a partial refund of the deposit may be made - this is at the discretion of Emotive Imagery.
c) Any monies paid before postponement of booking may, at the discretion of Emotive Imagery, be applied to the new wedding date.
d) Upgrades to, or within, album packages may be made at any time and the additional cost will become due in equal parts over the remaining balance payments.
e) All re-orders or additional products will be treated as an extension of the terms and conditions given herein.
f) All album/disc/USB Key prices are guaranteed for 12 months following the wedding but current pricing will apply beyond this date.
g) In the unlikely event of cancellation of photography services by Emotive Imagery or unavoidable failure to provide images, the photographers' liability is limited to a full refund of deposit and fees paid to Emotive Imagery. If practical a re-shoot may be undertaken but this will not include additional costs (such as suit hire, etc).
h) In the unlikely event that Emotive Imagery are unable to attend a booking, we will endeavour to secure a replacement photographer, although it cannot be guaranteed that a replacement photographer of the same quality can be located or for the same cost.
a) Emotive Imagery will endeavour to meet all reasonable client expectations and acheive all shots requested on the 'shot list' (completed approx. 1 month prior to the wedding date) within the given timeframe. However we make no express or implied warranty for providing specific images because it may not always be possible to acheive the shots due to events beyond our control such as restrictions applied by the church minister or civil registrar, inclement weather, changes to the venue, excessively late arrivals, etc. in such an event, alternative shots will be sought to provide coverage of your wedding day.
b) Following the pre-wedding consultation and 'shot list' completed, the photographer's judgment regarding location, poses and overall number of images captured on the day will be taken as correct.
c) Any changes to the booking are at the discretion of Emotive Imagery and must be agreed with them prior to being made. Should Emotive Imagery be unable to accommodate the change (such as date/venue/type of coverage) then the photographers are not obliged to compensate the clients in any way.
a) Emotive Imagery will not accept responsibility for the quality/colour reproduction of images printed via third parties from the Disc/USB stick provided. All images reproduced by Emotive Imagery will be from the same image bank as these media are drawn from and so should an inferior reproduction be obtained by the clients, it is their responsibility to refer back to the reproduction provider.
b) Due to limitations/variation in calibration of monitors, it is understood that the appearance of images may differ and that they may not match a printed version.
c) Given photochomatic anomalies cause by the combination of certain dyes and materials, it is sometimes impossible to record on camera the exact colour of materials as perceived by the hum eye. When processing images Emotive Imagery will endeavour to achieve a pleasing overall colour balance which will be based upon flesh tones rather than materials.
d) The clients understand that some colours may not remain constant throughout a set of photographs due to changing lighting conditions (i.e. daylight and disco lighting will produce different results) and that colour may not be identical over the whole range within a subject. It is also understood that the colour balance of prints made at different times may also vary.
e) Emotive Imagery only uses high quality CDs/DVDs/USB Keys for storage of data and each of these is checked prior to dispatch to clients. Therefore, it remains the responsibility of the clients to check for any damage incurred whilst in transit and Emotive Imagery cannot be held responsible for damage resulting from equipment resulting from defective media.
The copyright of images remains the property of Emotive Imagery and therefore it is illegal to copy images or allow them to be copied by any means photographic, by computer, internet or otherwise, by any person or machine other than by the photographers or their appointed agents unless a royalty-free licence has been granted. However, printing permission is given to clients with all Disc/USB copies provided for wedding packages. In reality, Emotive Imagery acknowledges that images may be posted on the likes of Facebook, etc and, as such we ask that these are posted with the acknowledgement of 'www.emotive-imagery.co.uk'.
Display and Use:
By booking the services of Emotive Imagery the clients provide the photographers with permission to use any images captured to generally promote the business by means of advertising, publicity material, websites, exhibitions, magazine articles, presentations and any other method as may be deemed acceptable - providing the images are used lawfully and without damage to the clients.
If a private gallery has been requested by the clients, Emotive Imagery will endeavour to keep the images private by use of a password. However this will not guarantee that they cannot be accessed by persons with the knowledge available to circumvent this level of security.
